Privacy Policy for Personal Data on the "Your Coach" Project

The current Privacy Policy for personal data (hereinafter referred to as the Privacy Policy) applies to all information that the application and website "Your Coach" (hereinafter referred to as "Your Coach") located at the domain name https://your-internet-coach.com (as well as its subdomains) may receive about the User during the use of the application and the website https://your-internet-coach.com (as well as its subdomains), its programs, and products (including the Your Coach application). The period of personal data storage is specified in paragraph 5.1 below

1. Definitions

1.1 This Privacy Policy uses the following terms:

1.1.1. “Website Administration” (hereinafter referred to as Administration) – authorized employees responsible for managing the "Your Coach" website, who organize and/or carry out the processing of personal data, and also determine the purposes of personal data processing, the composition of personal data subject to processing, and the actions (operations) performed with the personal data.

1.1.2. “Personal data” - any information related to an identified or identifiable individual (subject of personal data).

1.1.3. “Processing of personal data” - any action (operation) or set of actions (operations) performed with personal data using automation tools or without their use, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.

1.1.4. “Confidentiality of personal data” - a requirement that must be complied with by the Operator or any other person who has access to personal data, to prevent their dissemination without the consent of the subject of personal data or the presence of other legal grounds.

1.1.5. “Your Coach Website” - a collection of interconnected web pages located on the Internet at a unique address (URL): https://your-internet-coach.com, as well as its subdomains.

1.1.6. “Subdomains” - pages or a collection of pages located on third-level domains belonging to the "Your Coach" website, as well as other temporary pages at the bottom of which the contact information of the Administration is indicated.

1.1.7. “User of the "Your Coach" application and website” (hereinafter referred to as User) - a person who has access to the "Your Coach" application and website via the Internet and uses the information, materials, and products of the "Your Coach" website.

1.1.8. “Cookies” - a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser sends back to the web server in an HTTP request each time it tries to open a page of the corresponding site.

1.1.9. “IP address” - a unique network address of a node in a computer network through which the User accesses "Your Coach".

2. General Provisions

2.1. The use of the "Your Coach" application and website by the User indicates agreement with this Privacy Policy and the terms of processing the User's personal data.

2.2. In case of disagreement with the terms of the Privacy Policy, the User must cease using the "Your Coach" website.

2.3. This Privacy Policy applies to the "Your Coach" website. "Your Coach" does not control and is not responsible for third-party websites that the User may follow links to available on the "Your Coach" website.

2.4. The Administration does not verify the accuracy of the personal data provided by the User.

3. Subject of the Privacy Policy

3.1. This Privacy Policy establishes the obligations of the Administration to not disclose and ensure the confidentiality of personal data that the User provides at the request of the Administration during registration on the "Your Coach" website or when subscribing to the informational email newsletter.

3.2. The personal data permitted for processing under this Privacy Policy is provided by the User by filling out forms on the "Your Coach" website and includes the following information:
3.2.1. Last name, first name, patronymic of the User;
3.2.2. Contact phone number of the User;
3.2.3. Email address (e-mail);
3.2.4. User's place of residence (if necessary);
3.2.5. Photo (if necessary).

3.3. "Your Coach" protects the data that is automatically transmitted when visiting pages:
- IP address;
- information from cookies;
- browser information;
- access time;
- referrer (the address of the previous page).

3.3.1. Disabling cookies may result in the inability to access parts of the site that require authentication.

3.3.2. "Your Coach" collects statistics about the IP addresses of its visitors. This information is used to prevent, identify, and resolve technical problems.

3.4. Any other personal information not specified above (visit history, used browsers, operating systems, etc.) is subject to reliable storage and non-disclosure, except in cases provided for in paragraph 5.2 of this Privacy Policy.

4. Purposes of Collecting Users’ Personal Information

4.1. The Administration may use the User’s personal data for the following purposes:
4.1.1. Identifying the User registered on the "Your Coach" website for further authentication.
4.1.2. Providing the User access to personalized data of the "Your Coach" website.
4.1.3. Establishing feedback with the User, including sending notifications, requests regarding the use of the "Your Coach" website, processing requests and applications from the User.
4.1.4. Determining the User's location to ensure security and prevent fraud.
4.1.5. Confirming the accuracy and completeness of personal data provided by the User.

4.1.6. Creating an account for using parts of the "Your Coach" website if the User has consented to the creation of the account.
4.1.7. Notifying the User via email.
4.1.8. Providing the User with effective technical support in case of issues related to the use of the "Your Coach" website.
4.1.9. Providing the User, with their consent, special offers, newsletters, and other information on behalf of the "Your Coach" website.

5. Methods and Terms of Processing Personal Information

5.1. Processing of the User's personal data is carried out without time limitation, by any legal means, including in information systems of personal data using automation tools or without such tools.

5.2. The User's personal data may be transferred to authorized state authorities of the Russian Federation only on the grounds and in the manner established by the legislation of the Russian Federation.

5.3. In case of loss or disclosure of personal data, the Administration has the right not to inform the User about the loss or disclosure of personal data.

5.4. The Administration takes the necessary organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other unlawful actions by third parties.

5.5. The Administration, along with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.

6. Rights and Obligations of the Parties

6.1. The User has the right to:

6.1.1. Make a free decision regarding the provision of their personal data necessary for using the "Your Coach" website and to consent to its processing.

6.1.2. Update and supplement the provided information about their personal data in case of changes to that information.

6.1.3. The User has the right to obtain from the Administration information regarding the processing of their personal data unless such right is restricted in accordance with federal laws. The User has the right to demand that the Administration clarify their personal data, block or destroy it if the personal data is incomplete, outdated, inaccurate, obtained unlawfully, or not necessary for the stated purpose of processing, as well as to take legal measures to protect their rights. For this, it is sufficient to notify the Administration at the specified email address.

6.2. The Administration is obliged to:

6.2.1. Use the obtained information solely for the purposes stated in clause 4 of this Privacy Policy.

6.2.2. Keep confidential information secret, not disclose it without the prior written consent of the User, and not sell, exchange, publish, or disclose the User's personal data in any other possible way, except for the cases provided in clause 5.2 of this Privacy Policy.

6.2.3. Take precautionary measures to protect the User's personal data confidentiality in accordance with the procedures usually used to protect such information in existing business practices.

6.2.4. Block personal data related to the relevant User from the moment of the User’s request or application, or their legal representative or authorized body for the protection of the rights of personal data subjects, during the verification period in case of detection of false personal data or unlawful actions.

Responsibility of the Parties

7.1. The Administration, failing to fulfill its obligations, is liable for damages incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of the Russian Federation, except in cases provided for in paragraphs 5.2 and 7.2 of this Privacy Policy.

7.2. In case of loss or disclosure of Confidential Information, the Administration is not liable if this confidential information:
7.2.1. Became public knowledge before its loss or disclosure.
7.2.2. Was obtained from a third party before its receipt by the Administration of the Resource.
7.2.3. Was disclosed with the User's consent.

7.3. The User bears full responsibility for compliance with the requirements of the legislation of the Russian Federation, including laws on advertising, copyright and related rights protection, trademark protection, and any other applicable laws, including full responsibility for the content and form of materials.

7.4. The User acknowledges that the responsibility for any information (including, but not limited to: data files, texts, etc.) that they may access as part of the "Your Coach" website lies with the entity that provided such information.

7.5. The User agrees that the information provided to them as part of the "Your Coach" website may be an object of intellectual property, the rights to which are protected and belong to other Users, partners, or advertisers who place such information on the "Your Coach" website.
The User is not entitled to make changes, lease, lend, sell, distribute, or create derivative works based on such Content (in whole or in part), except in cases where such actions have been explicitly permitted in writing by the owners of such Content in accordance with the terms of a separate agreement.

7.6. The distribution of textual materials (articles, publications available in the public domain on the "Your Coach" website) is permitted provided that a link to "Your Coach" is given.

7.7. The Administration is not liable to the User for any loss or damage incurred by the User as a result of deletion, failure, or inability to save any Content and other communication data contained on or transmitted through the "Your Coach" website.

7.8. The Administration is not liable for any direct or indirect losses resulting from: the use or inability to use the website or individual services; unauthorized access to the User's communications; statements or behavior of any third party on the website.

7.9. The Administration is not liable for any information posted by the User on the "Your Coach" website, including, but not limited to, information protected by copyright, without the direct consent of the copyright owner.

8. Dispute Resolution

8.1. Before filing a claim with the court regarding disputes arising from the relationship between the User and the Administration, it is mandatory to submit a claim (a written proposal or an electronic proposal for voluntary dispute resolution).

8.2. The recipient of the claim must, within 30 calendar days from the date of receipt of the claim, notify the claimant in writing or electronically about the results of the consideration of the claim.

8.3. If an agreement is not reached, the dispute will be referred to the Arbitration Court of Krasnodar.

8.4. This Privacy Policy and the relationship between the User and the Administration is governed by the current legislation of the Russian Federation.

9. Additional Conditions

9.1. The Administration has the right to make changes to this Privacy Policy without the User's consent.

9.2. The new Privacy Policy comes into effect from the moment it is posted on the "Your Coach" website, unless otherwise provided in the new version of the Privacy Policy.
